New USCIS policy on evidence, RFE and NOID: August 2026 update

In my last video we analyzed the new USCIS policy on evidence, requests for evidence (RFE) and notices of intent to deny (NOID), effective since August 5, 2026.

1. New USCIS policy on evidence, RFE and NOID — August 5, 2026

This is the main document we analyze in the video. USCIS updated its policy on evidence, RFE, and NOID, giving officers greater discretion to decide when to request additional evidence and when to resolve a case based on the submitted record.

2. Form I-140 Instructions

This is the second document I showed you during the video. The instructions for Form I-140 are especially important because USCIS outlines how to complete the petition and what initial supporting evidence is required.
